Terms of Service

These terms apply when you buy a package, plan or service from Lushah Digital Inc. (“Lushah”, “we”, “us”), a company based in Ontario, Canada. By paying for a service or approving a quote, you agree to these terms.

1. Services and scope

Each package lists what is included. Anything not listed is outside the scope and will be quoted separately before we start it. Custom quotes and proposals form part of these terms.

2. Prices and payment

All prices are in Canadian dollars and exclude HST, which is added at checkout. Payments are processed securely by Stripe; we never see or store your full card details.

• One-time projects are paid in full upfront unless your quote says otherwise. Projects of $1,000 or more may be split into a 50% deposit and 50% before launch.
• Monthly and yearly plans renew automatically on the same date each period until cancelled.

3. Timelines and your content

Timelines start once we have everything we need from you, such as your logo, text, photos, logins and approvals. For the 24-Hour Website, the 24 hours are business hours (Monday to Friday, excluding Ontario statutory holidays) and start when we confirm we have received all of your content. Delays in providing content or feedback move the delivery date.

4. Revisions and support

Each project includes two rounds of revisions on the design before build, unless your package says otherwise. Additional changes after approval are billed at our hourly rate or quoted in advance.

The support period listed in your package starts on launch day and covers fixing anything we built that does not work as agreed, plus small text and image edits. New pages, features and redesigns are not included and will be quoted separately.

5. Ownership

Once paid in full, you own your website content, design and brand files we create for you. Third-party items such as themes, plugins, fonts, stock images and apps remain subject to their own licences. We may show your project in our portfolio unless you ask us not to in writing.

6. Third-party services

Hosting, domains, Shopify, payment processors and other tools are provided by third parties under their own terms and fees. Unless your quote says otherwise, our prices do not include domains, hosting, premium themes, paid plugins or apps; you buy these directly and they stay in your name. Copyright-free stock photos and videos we source for your project are included at no extra cost. We are not responsible for third-party outages, price changes or policies. 7. Ongoing plans

Care, Growth, SEO and Social plans cover the work described for each plan. Unused hours or posts do not roll over. SEO results depend on many factors outside our control, so we cannot guarantee specific rankings or traffic.

8. Launch pricing and referrals

Launch prices apply to orders paid on or before January 31, 2027. Plans bought at launch prices keep that price for as long as they stay active.

Referral credits: when a client you refer buys a website package of $799 or more and pays in full, you receive a $100 credit toward any of our services. Credits have no cash value, cannot be combined with other discounts on the same order, and expire 12 months after they are issued.

9. Your responsibilities

You confirm that you have the rights to any content you give us and that your business and website comply with applicable laws. You are responsible for keeping your account logins secure.

10. Limitation of liability

To the extent permitted by law, our total liability for any claim is limited to the amount you paid us for the service in question during the previous 12 months. We are not liable for indirect losses such as lost profits or data, except where the law does not allow this limit.

12. Governing law

These terms are governed by the laws of Ontario and the federal laws of Canada that apply there. Nothing in these terms limits any rights you have under Ontario’s Consumer Protection Act, 2002, if it applies to you.
